These Terms and Conditions govern the relationship between SASHA Safari Car Sharing LTD and any provider listed on SafariShare.travel for safari services, excursions, tourist transfers, vehicle provision, driving, and accompaniment. They define the conditions of access to the platform, collaboration, remuneration, compliance, liability, and removal from the platform.

The provider acts as an independent contractor. The provider is not an employee of SASHA, nor an exclusive agent, nor a legal representative of SASHA, unless expressly agreed in writing. The provider remains solely responsible for licenses, permits, insurance, tax obligations, qualifications, and documents required under applicable Rwandan law.

Every listed provider must be identified according to two independent axes. Vehicle status: vehicle owned by the provider; vehicle rented from a third party; or jointly owned vehicle or equivalent contractual arrangement. Driver status: the provider drives the vehicle personally; a separate driver drives the vehicle; or the provider may alternatively drive or appoint a separate driver depending on the assignment. In all cases, the provider profile or contract must clearly state who supplies the vehicle, who makes it available, who drives it, who organizes the tourist service, and who bears the related responsibilities.

SASHA provides a digital matchmaking platform. SASHA does not guarantee a minimum number of bookings, fixed income, or commercial exclusivity to the provider. SASHA may accept, suspend, or remove a provider in case of non-compliance, serious complaint, safety risk, misleading information, or breach of these Terms.

Where the vehicle belongs to the provider, the provider remains responsible for its compliance, insurance, maintenance, and lawful availability. The provider may then drive the vehicle personally or appoint an authorized separate driver.

Where the vehicle is rented from another provider or lessor, the renter becomes responsible for the use of the vehicle during the rental period in accordance with the rental contract. The renting provider may then drive the vehicle personally or appoint an authorized separate driver.

The provider is responsible for the vehicle, the driving, the tourist service, and passenger safety. The provider must hold the vehicle documents, applicable insurance, required authorizations, and a valid driving license.

The owner-provider remains responsible for the vehicle, insurance, maintenance, and lawful availability. The separate driver remains responsible for the license, driving, road traffic compliance, and safety during the trip. The organizing provider remains responsible for the service sold to the customer.

The vehicle lessor is responsible for providing a lawful, insured, and compliant vehicle. The provider-renter is responsible for driving, compliance with the rental contract, passenger safety, and damages caused during use.

The lessor is responsible for the vehicle and its delivery obligations. The provider-renter remains responsible for the tourist activity and for compliance with the customer contract. The separate driver remains responsible for driving, licensing, and road compliance.

The provider undertakes to provide accurate, complete, and up-to-date information; hold all required licenses, permits, and insurance policies; keep the vehicle roadworthy, clean, and compliant; ensure passenger safety; and inform SASHA of any incident, complaint, license withdrawal, or change affecting the activity.

Where a vehicle is rented to another provider, the lessor must deliver a vehicle that is authorized, insured, and compliant; set out usage conditions in writing; keep rental and handover documents; and disclose any restriction, defect, or usage limit.

The driver must hold a valid driving license; comply with traffic laws; drive carefully and professionally; not drive under the influence of alcohol, drugs, or any condition incompatible with safety; and follow the safety instructions of the organizing provider.

The organizing provider must ensure the delivered itinerary matches the sold service; inform the customer of the exact nature of the service; clearly indicate whether the vehicle is owned or rented from a third party; specify whether driving is performed by the provider or by a separate driver; and comply with applicable Rwandan tourism and transport rules.

Provider compensation shall be defined in writing in the offer, booking, or separate agreement. SASHA may deduct a commission or service fee clearly disclosed in advance. No hidden payment or undisclosed additional charge may be imposed.

The provider remains solely liable for any damage arising from its vehicle, driving, conduct, negligence, statements, or failure to comply with any legal obligation. SASHA is liable only for its own proven faults in platform management, to the extent permitted by mandatory law.

SASHA may suspend or terminate a provider's access to the platform in case of breach of these Terms, serious complaint, safety risk, fraud, impersonation, missing valid documents, or non-compliance with applicable law. The provider may end the collaboration upon reasonable notice, unless a serious breach justifies immediate termination.

The provider agrees to comply with applicable Rwandan data protection and privacy law when handling information received through the platform. Customer data may be used only for service performance purposes.

These Terms are governed by the laws of Rwanda. Mandatory consumer protection and safety rules shall prevail over any conflicting clause.
